Mariposa reserves the right to modify or withdraw, temporarily or permanently, the Website (or any part of it) with or without notice and shall not be liable to you or any third party for any modification or withdrawal of the Website. The terms and conditions related to the Products, return, and refund of the payment shall be governed by the policies as displayed on this website.

1. The user may carefully read all the information on products and services as provided in relevant sections and in FAQs.

2. Customers may register to use the services available from this website. Mariposa may decline a registration request at its sole discretion. By registering for the services, you agree that:

No material from this site or any other website owned, operated, controlled, or licensed by New Floral Studio LLP (Mariposa) and/or its affiliates or sister concerns may be copied, reproduced, republished, transmitted, downloaded, uploaded, or used in any manner for commercial purposes without explicit written permission. Any violation will be considered a breach of copyright, trademark, and other proprietary rights of the company and may result in legal action under applicable Indian laws.

All kinds of content associated with the New Floral Studio LLP (Mariposa) brand, including but not limited to the brand name, logo, product descriptions, images, and other materials, are governed by intellectual property laws. Unauthorized use, reproduction, distribution, or modification of any of these materials is strictly prohibited and may result in legal action. New Floral Studio LLP (Mariposa) reserves all rights to its intellectual property.

Furthermore, by posting any content featuring Mariposa products, customers grant us a non-exclusive, royalty-free, and worldwide right to use, reproduce, and distribute their images for marketing and promotional purposes. This includes use across various platforms, both online and offline, without any compensation.

New Floral Studio LLP (Mariposa) does not guarantee that the products or services will be error-free, that any defects will be corrected, or that this site or the server hosting it will be free of viruses or other harmful components. 7. There is sometimes a possibility of extra charges like Taxes or Duties which are to be borne by the recipient at the time of delivery. Please note that New Floral Studio (Mariposa) does not control these charges.

8. Since flower arrangements are handmade, there may be slight variations from the image shown and/or colour variations. The product specifications (such as weight, size, colour, etc.) mentioned alongside the product images are approximate. Since the products are handcrafted, there may be differences between the pictures and the actual items. Mariposa, at its sole discretion, may deliver a similar or alternative product due to circumstances beyond its control.

9. The flower arrangements cannot be guaranteed to be exact replicas of the ones shown on the site due to seasonal constraints. While the quantity of the product will remain the same, substitutions may occur if certain flowers or products are unavailable. Any substitutions made will be of equal or higher quality. Changes in the colour of flowers due to non-availability are also covered by this condition. Occasionally, substitutions of flowers or containers may be required due to temporary or regional availability issues. In such cases, our skilled florists will ensure that the style, theme, and colour scheme of your arrangement are maintained, and only items of equal or higher value will be substituted.

10. With respect to delivery and fulfilment of orders, New Floral Studio LLP (Mariposa) is not liable for any failure to fulfil orders due to circumstances beyond our control. This includes, but is not limited to, natural disasters, pandemics, labour strikes, customs delays, or disruptions in the supply chain and/or any such force majeure events. We will make every effort to ensure timely delivery, but unforeseen events may occasionally impact our ability to do so. We appreciate your understanding and patience in such cases. Also note that, by purchasing our products, customers agree to use them as intended. New Floral Studio LLP (Mariposa) is not liable for any kind of injuries, damages, or losses resulting from misuse of the products.

11. In an effort to provide our customers with the most current information, Mariposa will, from time to time, make changes in the Contents and in the products or services described on this Site. The prices advertised on this Site are for Internet orders. Prices and the availability of items are subject to change without notice. Any prices used on this Site may not be indicative of the actual selling prices in your area. We reserve the right to limit sales, including the right to prohibit sales to re-sellers. We are not responsible for typographical or photographic errors.

12. Notwithstanding any or all of the terms, conditions & disclaimers stated herein, any refund or payment by Mariposa for any reason whatsoever shall not become a waiver of these Terms and shall not set a precedent for similar future actions. All such refunds will be subject to a 10% deduction for bank charges and processing overheads. Refunds will be processed via the original payment method and are subject to the respective financial institution’s processing time.

13. Users who have availed services through Mariposa by selecting one or more listed service providers may be contacted by Mariposa via SMS, email, call, or WhatsApp messages after their scheduled appointment. These communications may request feedback or provide updates on the latest products from the service provider. Mariposa retains full ownership of this feedback collection process.

14. During peak seasons or special occasions, prices may vary without prior notice due to high demand. We recommend pre-booking your orders in advance with complete and accurate address and contact details to ensure timely processing. Please note that during such periods, fixed-time deliveries may not be available, and all deliveries will be scheduled based on route optimization and overall order volume. Orders placed after the announced cut-off time may be delivered the following day.

15. By using Mariposa, the user is presumed to have read all the terms and conditions outlined herein, as well as the FAQ, and is deemed to have unconditionally agreed to, understood, and accepted all the terms, conditions, procedures, and risks associated with using the services. Any disputes shall first be attempted to be resolved amicably within 30 days, failing which they shall be referred to a sole Arbitrator under the Arbitration and Conciliation Act, 1996, with jurisdiction in Mumbai, Maharashtra.
